We use “cookie” technology to collect additional website usage data and to improve your experience. A cookie is a small data file that is transferred to your computer’s hard disk. We may use both session cookies and persistent cookies to better understand how you interact with our Web site(s), to monitor usage and Web traffic, and to customize and improve your experience. Most Internet browsers automatically accept cookies. You can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the Web sites you visit. It is possible some of our features may not function properly if you disable cookies.

We also employ third party services that may collect certain non-personally identifiable information when you visit our site(s), such as the type of browser you are using, the type of operating system you are using, and the domain name of your Internet service provider. We use the non-personally identifiable information to improve the design and content of our site(s) and to enable us to personalize your experience. We also may use this information in the aggregate to analyze site usage, as well as to offer you products, programs, or services.

3. Disclosure

We may disclose personally identifiable information in response to legal process — for example, in response to a court order or a subpoena. We also may disclose such information in response to a law enforcement agency’s request or where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Use, or as otherwise required by law. In the event we are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. The promises in this Privacy Policy will apply to your information as transferred to the new entity.

Our agents and contractors who have access to your personal data are required to protect your information in a manner that is consistent with this Privacy Policy by, for example, not using the information for any purpose other than to carry out the services they are performing for us.

We use a variety of third-party services to operate our site(s), such as hosting, analytic, customer communication, advertising, and purchase processing services. These third-party service providers may collect information sent by your browser as part of a web page request, such as cookies or your IP address. We also may engage service providers to perform functions and provide services to us in the United States and abroad. We may share your personal data with such service providers subject to confidentiality obligations consistent with this Privacy Policy, and on the condition that the third parties use your private personal data only on our behalf and pursuant to our instructions.

Notwithstanding anything to the contrary in this Privacy Policy, we may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect our rights or property. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request that we disclose your information.

4. Your Rights and Choices

We respect your rights concerning the information we collect and use. If you are within the borders of the EU at the time we process your information, or if our relationship is subject to the laws of other jurisdictions that may so specify, you have the right to:

You may take technological steps to limit the non-personally identifiable information we collect. You may take legal action to prevent our disclosure of your information in response to a third party request, court order, or subpoena.

We may ask your permission to disclose personally identifiable information about you to companies whose practices are not covered by this Privacy Policy (e.g., other authorized licensees, marketers, magazine publishers, retailers, participatory databases and non-profit organizations) that want to market products or services to you. If at some point you grant us permission to transfer your information for these purposes and later decide that you no longer want us to do so, simply send us an email at privacy@johnwayne.com, and we will edit your preferences accordingly.

5. Security

We have put in place appropriate physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect about you.
